1. Services Offered
- 1.1 We offer an online service for you to buy tickets to events online from presenters.
- 1.2 We are not a presenter of any events listed on the website.
- 1.3 We are not responsible for the content or accuracy of any event information or any other information which is provided on the website by a presenter.
- 1.4 We do not hold tickets for any event. We simply facilitate the sale of tickets on behalf of the presenter. Tickets are sent by the presenter.
- 1.5 We are not selling any tickets. The presenter is selling the tickets and you are purchasing the ticket directly from the presenter. If you purchase a ticket through a reseller (or otherwise obtain any ticket not from the presenter), it may not be valid and we have no obligations in relation to that ticket.
- 1.6 The website is operated by The Elephant Group Ltd.
2. User Obligations
- 2.1 By accessing and using the website, you agree to be bound by these Terms.
- 2.2 You agree not to use the website for any unlawful purpose, or in any way that may interfere with the use of the website by other users. You agree not to modify, reproduce, duplicate, copy, sell, resell, exploit or download any part of the website or the services for any commercial purpose.
- 2.3 All material in the website is copyrighted, trademarked or otherwise protected by intellectual property laws.
- 2.4 The website and the services offered by the website are only for your personal, non-commercial use.
- 2.5 You must not interfere with or disrupt other users or our support systems.
3. Capacity to Contract
- 3.1 You must be 18 years of age or older to purchase tickets by credit card. If you are under the age of 18 years old, you must obtain the consent of your parent or legal guardian before you may use the website.
- 3.2 You must be a resident of New Zealand, have a New Zealand credit card and delivery address and be able to accept delivery in New Zealand.
- 3.3 You will be deemed to have the capacity to enter into the terms and conditions of these Terms.
4. Ticket Sale Online
- 4.1 When you submit an order for tickets through the website you are making an offer to purchase those tickets from the presenter on the terms set out in these Terms. The sale is not binding until it is accepted by the presenter.
- 4.2 Upon acceptance of your order by the presenter, a binding contract will be formed between you and the presenter.
- 4.3 The ticket sale will not be binding upon the presenter until full payment is made and the tickets are delivered to you.
- 4.4 We do not guarantee ticket delivery times. We are not liable for any delays. If your ticket has not been delivered, please contact us. If your ticket has been purchased through an agent or outlet, please contact the agent or outlet.
- 4.5 We are not liable for any loss if you have chosen postal delivery and you do not receive your ticket. We are not liable for any tickets stolen.
- 4.6 Presenters may make corrections in the event information (such as the date, time, venue, time, performers and the like) with or without notice and without liability. If event information is incorrect, or an event is cancelled or changed, you should contact us or the presenter regarding the possibility of a refund or exchange of ticket. We are not responsible or liable for the non-performance or failure of any presenter.
- 4.7 We reserve the right to cancel any tickets or refuse sale of tickets if there is a website error or mistake.
- 4.8 Presenters may set minimum and maximum ticket limits per transaction.
- 4.9 Presenters may set sales restrictions.
5. Returns, refunds and cancellations
5.1 No refunds or exchanges are permitted except as required by law or otherwise permitted by the presenter (in their sole discretion).
6. Lost, Stolen, Damaged or Destroyed Tickets
6.1 It is your responsibility to keep your ticket safe. We do not replace lost, stolen, damaged or destroyed tickets. If your ticket has not been delivered, please contact us.
7. Ticket Resale
7.1 The Presenter disallows resale of the ticket. We will not exchange or refund any tickets purchased from a third party.
8. Ticket Usage
- 8.1 You must comply with the conditions of entry which the presenter has set for the event. If the presenter determines that you are not complying with these conditions, or are committing a criminal or disorderly conduct, you may be evicted. Your ticket will not be refunded.
- 8.2 We may void any ticket or refuse entry if the ticket was obtained through an advertising, marketing, giveaway, competition or raffle. You may be refused entry if you are unable to produce evidence of your identity or the prize, as requested.
9. Pass-Outs and Re-Entry
9.1 You should read your ticket in order to check whether there is a re-entry or pass-out allowance. If you wish to re-enter the event then you must keep your ticket. The pass-out is at the discretion of the presenter and they may refuse re-entry if they consider it necessary for safety and security reasons.
10. Privacy Policy
10.1 Our use of information collected from you through the website is governed by our Privacy Policy.
11. Definitions
- 11.1 "presenter" refers to the party presenting the event, which may include, but is not limited to, a promoter, producer, team, band or venue.
- 11.2 "website" means and includes www.aaaticketing.co.nz, aaaticketing.co.nz and any page derived from these websites and any page owned by AAA Ticketing.
